Terms of Service

Welcome to CritiqueMe ("CritiqueMe," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the CritiqueMe website, mobile applications, services, and platform (collectively, the "Platform").

By accessing or using CritiqueMe, you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old to use CritiqueMe. If you are under the age required by law in your jurisdiction, you may only use the Platform with parental or guardian permission.

By using the Platform, you represent and warrant that:

• You are legally capable of entering into these Terms
• The information you provide is accurate
• You will comply with all applicable laws and regulations

2. Platform Purpose

CritiqueMe is a platform for creatives to:

• Share creative work
• Receive constructive feedback
• Discover other creatives
• Build professional creative communities
• Share creative resources and inspiration

CritiqueMe is not a marketplace, employer, agency, escrow service, legal authority, or intellectual property enforcement agency.

3. User Content

Users may upload images, videos, Figma links, comments, feedback, profile information, creative portfolios, and other content ("User Content").

You retain ownership of your User Content.

By posting content on CritiqueMe, you grant CritiqueMe a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, and promote your content solely for operating, improving, and promoting the Platform.

This license ends when your content is deleted from the Platform, except where:

• Content has been shared by others
• Legal retention obligations apply
• Backup systems temporarily retain data

4. Intellectual Property & Stolen Work

CritiqueMe respects intellectual property rights.

Users are solely responsible for ensuring they have the rights to upload, share, or distribute any content posted on the Platform.

CritiqueMe:

• Does not verify ownership of uploaded work
• Does not guarantee originality of content
• Is not responsible for stolen, copied, infringed, or unauthorized content uploaded by users
• Is not liable for disputes between users regarding ownership or originality

If you believe content infringes your intellectual property rights, you may submit a takedown request to critiquemeusa@gmail.com.

Your request should include:

• Identification of the copyrighted work
• Identification of the allegedly infringing material
• Proof of ownership or authorization
• Your contact information
• A good faith statement under applicable law

CritiqueMe reserves the right to remove content, suspend accounts, terminate repeat infringers, and cooperate with legal authorities.

5. Prohibited Conduct

You agree not to:

• Upload stolen or unauthorized work
• Violate intellectual property rights
• Harass, threaten, or intimidate others
• Post hateful, racist, discriminatory, abusive, or harmful content
• Spam or manipulate engagement
• Impersonate another person or company
• Use bots, scrapers, or automated systems without permission
• Attempt unauthorized access to systems or accounts
• Circumvent moderation or safety systems
• Share malware, malicious code, or harmful links
• Sell illegal or prohibited products/services
• Use the Platform for unlawful purposes

CritiqueMe may remove content or accounts at its sole discretion.

6. Constructive Feedback Policy

CritiqueMe is built around constructive creative critique. Users must provide feedback respectfully and professionally.

The following are prohibited:

• Harassment
• Personal attacks
• Hate speech
• Bullying
• Threats
• Sexually explicit abuse
• Discriminatory language
• Harmful or malicious commentary

CritiqueMe may automatically moderate comments, flag comments for review, remove content, restrict user features, and suspend or terminate accounts. Users are responsible for their own comments and interactions.

7. Private Content & Audience Controls

CritiqueMe allows users to set profiles to private, share posts publicly, restrict posts to followers, or restrict posts to selected users.

While CritiqueMe implements privacy controls, no digital platform can guarantee absolute security or confidentiality.

Users should avoid uploading confidential, proprietary, trade-secret, or NDA-protected material unless they are fully authorized to do so.

CritiqueMe is not responsible for unauthorized screenshots, redistribution by viewers, off-platform sharing, or user misuse of shared content.

8. Account Termination

CritiqueMe may suspend or terminate accounts for violating these Terms, fraudulent activity, abuse or harassment, repeated policy violations, illegal conduct, or security risks.

Users may stop using the Platform at any time. CritiqueMe may retain certain data as required by law or legitimate operational needs.

9. Third-Party Services

The Platform may integrate with third-party services including Figma, cloud storage providers, analytics tools, authentication providers, and payment providers (future).

CritiqueMe is not responsible for third-party platforms, content, services, availability, or policies. Use of third-party services is governed by their own terms.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." CritiqueMe makes no warranties regarding Platform availability, accuracy of user content, reliability of feedback, originality of uploaded work, results from using the Platform, or security or uninterrupted service.

CritiqueMe does not guarantee that content will remain available permanently, that bugs or interruptions will never occur, or that moderation systems will catch all harmful content.

11. Limitation of Liability

To the maximum extent permitted by law, CritiqueMe and its affiliates, officers, employees, contractors, and partners shall not be liable for indirect damages, consequential damages, lost profits, lost opportunities, data loss, reputation damage, intellectual property disputes between users, user-generated content, or unauthorized redistribution of content.

Your use of the Platform is at your own risk.

12. Indemnification

You agree to defend, indemnify, and hold harmless CritiqueMe from claims, liabilities, damages, losses, and expenses arising from your use of the Platform, your uploaded content, your interactions with other users, your violation of these Terms, or your violation of intellectual property rights.

13. Changes to the Platform

CritiqueMe may modify features, remove functionality, restrict access, update policies, or change availability at any time without liability.

14. Changes to Terms

We may update these Terms periodically. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by the laws of New York, USA, without regard to conflict-of-law principles.
